1. Operator and contact
The platform formacion.createctura.es is managed by ASOCIACIÓN PEDAGÓGICA ILER (Innovative Learning Environments Research), tax identification number G39810619, with its registered address at Calle Menéndez Pelayo, 16, 6.º D, 39700 Castro Urdiales (Cantabria), Spain. It is registered in Spain’s National Register of Associations, Section 1, under national number 621441. For questions about enrolment, payments, access or these terms, please write to formacion@createctura.es.
2. Purpose and scope
These terms govern purchases of the online courses offered on the platform. Before purchase, each course page specifies its content, language, price, access period, included live meetings and particular requirements. That information forms part of the contract.
3. Personal account required
Every purchase must be associated with a personal account. Guest purchases are not permitted. Users must provide accurate information, keep their credentials confidential and report any unauthorised use. The account, content and access links are personal and may not be shared or resold.
4. Ordering process
To purchase a course, you must select it, sign in or create an account, review the price and essential features, select a payment method and accept these terms before confirming an order with an obligation to pay. You will then receive an order confirmation by email and, where applicable, confirmation of access.
You can correct your information before confirming the purchase. If you subsequently notice an error, write to formacion@createctura.es with your name, account email address and course.
The contract is concluded in Spanish or French, depending on the version used during purchase. The confirmation and these terms can be saved or printed.
5. Prices and taxes
The applicable prices are those published on the course page and final checkout screen. Prices are shown in euros and include any legally applicable taxes. No charges other than those shown before order confirmation will be added.
6. Payment methods and activation
- PayPal or card through the available payment gateway: when the platform confirms payment, the order and access may be activated automatically.
- Bank transfer: the order remains pending until Createctura verifies receipt of payment. To help identify it, follow the instructions received and send proof of payment to
formacion@createctura.es, stating the account name and email address. - Bizum: available only for payments from Spain. The order remains pending until Createctura verifies the payment and the proof sent to
formacion@createctura.es.
Receipt of an order does not mean that access is active. Access begins when the order is marked as completed and the corresponding confirmation is sent.
7. Duration and delivery of the course
The access period is specified for each course and begins on the activation date. Unless the course page states otherwise, access is flexible and participants can progress at their own pace during that period.
Meetings in Spanish are scheduled for the first Tuesday of each month, and meetings in French for the second Tuesday. Specific dates, times, recordings and support channels are detailed on the course page or within each course. Future dates may change for a justified reason; enrolled participants will be informed of any significant change.
8. Technical requirements and support
To use the platform, you need an internet connection, an up-to-date browser and a device capable of playing video and audio. The platform supports computers, tablets and mobile phones, although some longer tasks may be more comfortable on a computer. If you have access problems, write to formacion@createctura.es.
9. Intellectual property and permitted use
Videos, texts, images, documents, recordings and other materials are protected by intellectual property law. Enrolment grants only a personal, limited, non-exclusive and non-transferable right to use the materials during the access period. Copying, distributing, publishing or reselling them, sharing credentials or using them to create a substitute course is prohibited unless written permission or an applicable legal exception allows it.
10. Right of withdrawal and immediate access
As a general rule, if you purchase as a consumer, you have fourteen calendar days to cancel the purchase without giving a reason.
With automatic payments — PayPal or card — access may be activated immediately. For bank transfers or Bizum, access begins only when Createctura verifies payment and manually activates the order. To allow the course to begin before the fourteen days have elapsed, we will request separate authorisation during checkout.
Payment alone does not remove the right of withdrawal. For digital content, that right is lost only when access has actually been activated and supply has begun with your express consent. This does not limit your rights in the event of defective content, lack of access or a breach by Createctura, nor does it automatically extend to future services not yet provided, such as upcoming online meetings.
In practice: if you have paid by bank transfer or Bizum but Createctura has not yet correctly activated access, payment does not prevent you from exercising your right of withdrawal within the time limit. If you requested immediate access, it is working and you have started the course, you cannot use withdrawal to take the course and then cancel it simply because you change your mind. If Createctura does not provide the promised access or service, you retain your rights to complain, have the problem resolved and, where applicable, receive a refund.
To exercise your right of withdrawal, send an unequivocal statement to formacion@createctura.es, giving your name, account email address, course and order date. You may use the following model, although this is not mandatory:
To ASOCIACIÓN PEDAGÓGICA ILER: I hereby give notice that I withdraw from the contract concerning the course [name], ordered on [date], in the name of [name], with the email address [email]. Date and signature if submitted on paper.
11. Problems, cancellations and refunds
Nothing in these terms limits consumers’ statutory rights. If Createctura cancels a course or cannot supply the purchased content, it will offer an equivalent solution where appropriate or refund the corresponding amounts. Problems are handled individually through formacion@createctura.es.
12. Platform availability
Createctura aims to keep the platform available and maintain access throughout the purchased period. Temporary interruptions may occur for maintenance, security, updates or reasons beyond its control. If a significant problem prevents access for a substantial period, a proportionate solution will be adopted, such as extending the access period.
13. Personal data
Personal data will be processed to manage the account, purchase, payment, access, communications related to the course and compliance with legal obligations. Full information about the controller, legal bases, recipients, retention and rights should be consulted in the platform’s Privacy Policy.
14. Complaints, applicable law and jurisdiction
You may send any enquiry or complaint to formacion@createctura.es. Spanish law applies, without prejudice to mandatory consumer protection rules applicable in the user’s place of residence. Disputes will be submitted to the courts with jurisdiction under consumer legislation; no different jurisdiction is imposed where the law protects the consumer.
15. Changes
The applicable version is the one accepted when placing the order. Future changes will not apply retroactively to purchases already made unless they are favourable or legally necessary.
